Terms of Service

These Terms of Service govern your use of the TravelStacks platform and services operated by Travel Stacks LLC. Please read them carefully before using the site.
1. Acceptance of Terms
1.1 Agreement to Terms
By accessing or using the TravelStacks website at travelstacks.com, including any subdomains, mobile interfaces, or related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
1.2 Capacity to Contract
By accepting these Terms, you represent that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are accessing the Service on behalf of another person, you represent that you have authority to bind that person to these Terms.
1.3 Electronic Agreement
These Terms constitute a legally binding agreement made electronically. No physical signature is required for these Terms to be enforceable.
2. Description of Service
2.1 What TravelStacks Does
TravelStacks provides a flight compensation claims processing service. Specifically, we:
- (a)Check flight eligibility for compensation under applicable passenger rights regulations, including US Department of Transportation (DOT) rules, EU Regulation 261/2004 (EU261), and UK Retained Regulation 261/2004 (UK261);
- (b)Submit claims on behalf of passengers to airlines and relevant authorities;
- (c)Follow up with airlines, respond to denials, and escalate claims through regulatory complaint channels where appropriate;
- (d)Collect recovered compensation and disburse net amounts to passengers after deducting applicable fees.
2.2 Scope of Regulations Covered
The Service currently covers passenger rights under: (a) US DOT regulations, including refunds for cancellations and significant delays, involuntary denied boarding compensation, and tarmac delay rules; (b) EU Regulation 261/2004 for flights departing from EU airports or operated by EU carriers arriving at EU airports; and (c) UK Retained Regulation 261/2004 for flights departing from UK airports or operated by UK carriers arriving at UK airports.
2.3 Service Limitations
TravelStacks is not a law firm, airline, travel agency, or regulatory body. We do not guarantee specific outcomes. The Service is limited to the claim types and jurisdictions described herein, and eligibility determinations are estimates based on available data at the time of assessment.
3. Eligibility
3.1 Age Requirement
You must be at least 18 years of age to use the Service or submit a claim.
3.2 Authorized Representatives
You may use the Service on behalf of another passenger (such as a minor child, spouse, or traveling companion) if you are their authorized representative. By submitting a claim on behalf of another person, you represent that you have the authority to act on their behalf and to bind them to any agreement entered into through the Service.
3.3 Claim Ownership
You represent that you have a legitimate ownership interest in the claim you are submitting, that the claim has not been previously assigned or transferred to any third party, and that you are not simultaneously pursuing the same claim through any other service, legal representative, or directly with the airline.
4. Account Registration
4.1 Account Creation
To submit a claim, you will be required to create an account or authenticate through our authentication provider. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
4.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at support@travelstacks.com if you suspect any unauthorized access to your account.
4.3 Account Accuracy
Providing false or misleading information during account creation or claim submission may result in termination of your account and forfeiture of any pending claims.
5. Service Fees
5.1 US Refund and Reimbursement Claims
For claims seeking a refund of a purchased ticket or reimbursement of out-of-pocket expenses under US DOT rules, TravelStacks charges a flat fee of $19.00 USD per claim. This fee is charged at the time you authorize the claim via our checkout process and is non-refundable once the claim has been submitted to the airline. The flat fee covers all follow-up, escalation, and regulatory complaint steps required to recover your refund.
5.2 Compensation Claims (Success Fee)
For claims seeking fixed cash compensation under EU261, UK261, or US DOT involuntary denied boarding rules, TravelStacks charges a success fee only if compensation is successfully recovered. No upfront payment is required. The applicable success fee tier is determined by the effort required to recover compensation:
- (a)25% of the recovered amount if the claim is resolved through standard direct submission to the airline;
- (b)35% of the recovered amount if recovery requires follow-up, dispute correspondence, or pushback on a denial;
- (c)45% of the recovered amount if recovery requires escalation to a regulatory body, National Enforcement Body, the Civil Aviation Authority, or the US Department of Transportation.
The applicable fee tier will be disclosed to you before any payout is processed. You will always be shown the net amount you will receive after fees before disbursement is completed.
5.3 No Recovery, No Fee (Compensation Claims)
For compensation claims under Section 5.2, if TravelStacks is unable to recover any compensation on your behalf, you owe no fee whatsoever. The success fee applies only to amounts actually recovered.
5.4 Fee Changes
TravelStacks reserves the right to modify the fee structure described in this Section. Any fee changes will apply only to claims submitted after the effective date of the modification. Fees applicable to a claim are fixed at the time the claim is authorized.
6. Claim Process
6.1 Eligibility Assessment
Upon submission of your flight details, TravelStacks will assess your claim for eligibility based on available flight data and applicable regulations. Eligibility assessments are estimates. Final eligibility is determined by the airline and, where applicable, regulatory authorities.
6.2 Claim Submission
Once you authorize a claim, TravelStacks will submit the claim to the relevant airline on your behalf. We will include all information required by applicable regulations and the airline's stated claims procedures.
6.3 Follow-Up and Escalation
TravelStacks will follow up with the airline according to our standard escalation schedule. If the airline does not respond or denies a valid claim, we will escalate through available channels including formal demand letters, regulatory complaint filings, and other reasonable measures. We do not guarantee that escalation will result in a successful outcome.
6.4 Timelines
Claim resolution timelines vary significantly depending on the airline, jurisdiction, and claim complexity. Typical resolution times range from a few weeks to several months. We will provide updates on the status of your claim through your account and via email or SMS as significant developments occur.
6.5 No Guarantee of Outcome
TravelStacks does not guarantee that any claim will result in compensation or that any specific amount will be recovered. Airlines have the final authority to accept or deny claims. Regulatory complaints and legal proceedings have uncertain outcomes. Our role is to pursue your claim diligently and in good faith, not to guarantee a result.
7. Authorization
7.1 Limited Power of Attorney
By submitting a claim through the Service, you grant Travel Stacks LLC a limited, revocable authorization to act as your representative for the specific purpose of processing your claim. This authorization includes the right to:
- (a)Communicate with the relevant airline on your behalf;
- (b)Submit claims, supporting documentation, and correspondence to the airline and relevant regulatory bodies;
- (c)File complaints with the US Department of Transportation, EU National Enforcement Bodies, the UK Civil Aviation Authority, or other applicable regulators;
- (d)Negotiate settlement of your claim with the airline;
- (e)Receive funds recovered on your behalf, deduct applicable fees, and remit the net amount to you.
7.2 Scope Limitation
This authorization is limited to the specific claim submitted and does not constitute a general power of attorney. TravelStacks is authorized only to take actions reasonably necessary to process and recover your claim.
7.3 Revocation
You may revoke this authorization at any time by contacting support@travelstacks.com. See Section 13 (Termination) for the consequences of revocation.
8. No Legal Advice
8.1 Claims Processing Service Only
TravelStacks is a claims processing service, not a law firm. Nothing on this website, in our communications, or through our Service constitutes legal advice. Our eligibility assessments are based on publicly available regulatory guidance and flight data, not formal legal analysis.
8.2 No Attorney-Client Relationship
No attorney-client relationship is created by your use of the Service or by any communication between you and TravelStacks. For legal advice specific to your situation, you should consult a qualified attorney.
9. Limitation of Liability
9.1 Exclusion of Consequential Damages
To the maximum extent permitted by applicable law, Travel Stacks LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service, including but not limited to: claim denials by airlines; regulatory decisions adverse to your claim; delays in claim processing; amounts recovered being less than expected; or loss of data.
9.2 Cap on Liability
Travel Stacks LLC's total cumulative liability to you for any claims arising under or related to these Terms or the Service shall not exceed the total fees actually paid by you to TravelStacks in connection with the specific claim giving rise to the liability, or $50.00 USD, whichever is greater.
9.3 Essential Basis of the Bargain
The limitations of liability set forth in this Section reflect a reasonable allocation of risk and form an essential basis of the bargain between TravelStacks and you. These limitations apply regardless of the theory of liability (contract, tort, statute, or otherwise) and even if TravelStacks has been advised of the possibility of such damages.
9.4 Indemnification
You agree to indemnify, defend, and hold harmless Travel Stacks LLC and its officers, directors, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) any false or misleading information you provide; or (d) your infringement of any third-party rights.
10. Intellectual Property
10.1 Ownership
All content, branding, software, tools, processes, designs, text, graphics, and other materials on or accessible through the Service are the property of Travel Stacks LLC or its licensors and are protected by applicable intellectual property laws.
10.2 Limited License
TravelStacks grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use of submitting and tracking your own flight compensation claims. No other use is permitted without express written consent.
10.3 Prohibited Uses
You may not copy, reproduce, distribute, create derivative works from, or commercially exploit any content or functionality of the Service. You may not use automated tools to scrape, crawl, or extract data from the Service.
11. Privacy
11.1 Privacy Policy
Your use of the Service is also governed by our Privacy Policy, located at travelstacks.com/privacy, which is incorporated by reference into these Terms. By using the Service, you consent to our collection, use, and sharing of your information as described in the Privacy Policy.
11.2 Data Use for Claim Processing
By submitting a claim, you authorize TravelStacks to share your personal information (including name, contact details, and flight information) with airlines, regulatory bodies, and other third parties as reasonably necessary to process your claim.
12. Dispute Resolution
12.1 Governing Law
These Terms and any disputes arising from or related to the Service shall be governed by and construed in accordance with the laws of the State of California, USA, without regard to its conflict of law provisions.
12.2 Informal Resolution
Before initiating formal dispute proceedings, you agree to contact TravelStacks at support@travelstacks.com and attempt to resolve the dispute informally. We will make reasonable efforts to resolve disputes within 30 days of receiving written notice.
12.3 Binding Arbitration
If informal resolution is unsuccessful, any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered under the American Arbitration Association's Consumer Arbitration Rules. The arbitration shall be conducted in Sonoma County, California, or by video conference if agreed by both parties.
12.4 Class Action Waiver
To the maximum extent permitted by law, you waive any right to participate in a class action, class arbitration, or collective proceeding against TravelStacks.
12.5 Small Claims Exception
Notwithstanding Section 12.3, either party may bring an individual claim in small claims court in Sonoma County, California, if the claim qualifies for small claims court jurisdiction.
13. Termination
13.1 Termination by You
You may stop using the Service at any time. To cancel a pending claim, contact support@travelstacks.com. See Section 5 and the Claim Agreement for the fee consequences of cancellation at different stages.
13.2 Termination by TravelStacks
TravelStacks may suspend or terminate your account and access to the Service at any time, with or without notice, for any reason, including if we reasonably believe you have violated these Terms, provided false information, or engaged in fraudulent activity.
13.3 Effect on Pending Claims
Termination of your account does not automatically cancel any claims already submitted to an airline on your behalf. Where a claim has already been submitted, TravelStacks will continue to pursue the claim to completion unless you explicitly withdraw it. The fee terms applicable at the time of submission continue to apply to any recovered amounts.
14. Modifications to Terms
14.1 Right to Modify
TravelStacks reserves the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date at the top of this page and, where practicable, by sending an email notification to registered users.
14.2 Continued Use as Acceptance
Your continued use of the Service after any modification takes effect constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service.
14.3 No Retroactive Changes
Modifications to these Terms will not affect claims submitted before the effective date of the modification. The terms in effect at the time a claim is submitted govern that claim.
