When a Tarmac Delay Triggers Compensation

Compensation triggers are distinct and additive:

  • US domestic tarmac rule: no cash compensation for passengers directly. DOT fines the airline up to $27,500 per passenger. You do NOT collect that fine.

  • EU261 delay compensation: cash EUR 250 / 400 / 600 by distance if arrival at final destination is delayed 3+ hours (including tarmac time).

  • UK261 delay compensation: mirrors EU261, GBP 220 / 350 / 520 bands.

  • EU/UK tarmac rule (4-hour limit): airline must offer deplaning; no statutory cash but fuels a care-costs claim.

A 5-hour tarmac delay at JFK on a Paris-to-JFK flight triggers: (a) EU261 EUR 600 compensation if arrival is 3+ hours late, (b) refund if you decide not to continue, (c) DOT care obligations (food, water, toilet access, medical if needed).

When You Get Both Refund and Compensation

On a covered EU/UK flight, you can collect both a refund (for the ticket) and compensation (for the disruption) in these scenarios:

  • Flight cancelled after long tarmac: refund + EU261 compensation (if <14-day notice).

  • You decline an alternative more than 2 hours later: refund + partial compensation (50 percent reduction rule).

  • Rebook puts you on the next day's flight: care costs + refund option + full compensation if 3+ hours late to destination.

What the Airline Owes During the Tarmac Event

  • Food and potable water within 2 hours

  • Working toilets the entire time

  • Medical attention if needed

  • Option to deplane at 3 hours (domestic) or 4 hours (international)
