Significant Cancellation Under DOT: The New Standard

DOT's October 2024 final refund rule defined what counts as a significant cancellation for refund purposes. This guide covers the definition, the exceptions, and how airlines have tried to interpret their way around it in 2025 and 2026.

The Definition at 14 CFR 259.5

Under 14 CFR 259.5, any cancellation by the carrier is a significant cancellation DOT category triggering automatic refund rights. Unlike delays (which require 3 hours domestic or 6 hours international), cancellations do not have a threshold. If the flight is cancelled, the passenger gets the refund option.

Cancellation is binary, not tiered. Any cancellation, for any cause, triggers the refund right. Weather, ATC, crew, mechanical, scheduled maintenance, low load factor, oversales, all trigger the right equally.

Refund Mechanics

Under the 2024 rule, when a flight is cancelled:

  • Refund must be to original payment method (not vouchers, not store credit).

  • Refund must include all fees and taxes paid for the unused segment.

  • Refund must be issued within 7 business days for credit card purchases, 20 days for cash or check.

  • Automatic refund required if passenger does not affirmatively accept rebooking (the 2024 rule shifted the default from opt-in to opt-out).

  • Vouchers only binding if accepted in writing with clear disclosure.

What Counts as Cancellation

DOT's rule covers:

  1. 1

    Full cancellation: the flight does not operate at all.

  2. 2

    Schedule change resulting in cancellation of your specific segment: the airline consolidates flights and your specific flight number is no longer operating.

  3. 3

    Equipment cancellation: aircraft swap that results in cancellation for weight or configuration reasons.

  4. 4

    Diversion turning into cancellation: if the crew times out during a diversion and the flight cannot continue.

  5. 5

    Partial cancellation: one leg of a multi-segment itinerary cancelled, giving you the right to refund that leg.

Rebooking Rights vs Refund Rights

The 2024 rule gives you the choice. You can take:

  • Cash refund to original payment method, and walk away.

  • Rebooking at no charge on next available flight, same airline or partner.

  • Rebooking on a competitor if the airline's schedule has no option within a reasonable time.

  • Refund for the unused segment plus keep the flown segment, for partial cancellations.

What Airlines Have Tried

Since the 2024 rule took effect, airlines have tested various interpretations:

  • Voucher default: continuing to offer vouchers first, hoping passengers do not assert cash refund right.

  • Claim the cancellation was "operated": arguing that a rebooking on a later flight is "operating" the original flight number.

  • Consolidation confusion: cancelling a flight but rebooking on a consolidated flight and treating it as if nothing changed.

  • Fare class lock-in: offering refund only in original fare class credit rather than cash.

  • Delay tactic: refunding on a 30 to 60 day timeline instead of the required 7 business days.

DOT has fined multiple airlines for non-compliance since 2024. Delta, Spirit, Frontier, and Allegiant have all faced enforcement action for slow or non-cash refunds.

Interaction with Other Rules

Significant cancellation rights coexist with:

  • Contract of Carriage: airlines's own promises (duty of care, etc.) apply if more generous.

  • EU261 on return legs: if the cancelled flight was on an EU carrier from an EU airport, EU261 cash compensation is separate from and in addition to the DOT refund.

  • Customer service plan: controllable cancellations trigger meal/hotel amenities under airline's own plan.

Claim Enforcement

If the airline does not provide the automatic refund or attempts to force a voucher, file a DOT complaint at transportation.gov/airconsumer.
